Spring-Summer Care Plan Membership Terms
Version 1.3, October 29, 2026.
1. The parties
These terms are between you and Lion Path Inc. dba Tahoe Chimney & Fireplace ("TCF"), P.O. Box 9526, Truckee, CA 96162, (530) 414-7600, admin@tahoestoves.com. CSLB #949777, NV Lic. #0084665.
2. What the membership is
The Spring-Summer Care Plan is a 12-month membership, priced per appliance. Your membership fee covers: (a) one included maintenance visit per enrolled appliance per term, being a chimney cleaning and visual safety inspection (wood-burning), a gas fireplace service (gas) or a pellet stove service (pellet), with a written report and photos, for one appliance, one flue and one standard ladder setup; (b) the member service benefits in section 5; and (c) the member discounts in section 6, which become available after your included visit is performed. Each included visit is recorded on its own service ticket at no additional charge. The fee is a membership fee. It is not a prepayment for repair or installation work.
3. Your 12-month term
Your term is 12 months. If you join between March 1 and August 31, your term starts the day you join. If you join between September 1 and the last day of February, your term starts the following March 1. Your member service benefits start the day you join, even if your term starts later. Your confirmation email states your exact start and end dates.
4. Your included visit
- Included visits are scheduled between March 1 and August 31 of your term. TCF does not schedule or perform your included visit until the cancellation period in section 10 has ended.
- Members choose their visit date before TCF opens booking for that season to the public.
- TCF emails a proposed date and makes three attempts to confirm. If you do not respond, your visit is still included and is scheduled in order with other customers within the window.
- If TCF cannot complete your included visit by August 31, TCF schedules it as soon as possible afterwards within your term. If it cannot be done within your term, TCF refunds your fee in full.
5. Member service benefits
These start the day you join and continue to the end of your term.
- Offered service date within 3 weeks. When you call for a repair or service on an enrolled appliance, TCF offers you a service date within 3 weeks of your call. This applies to repair and service calls only, not installations. It does not apply to emergencies TCF refers elsewhere, bad weather, or times when you cannot provide access. It is an offered date, not a promise that a repair will be completed by that date.
- Member line. A direct member phone line, with a reply within one business day.
- First pick of spring visit dates, as in section 4.
- Service records kept on file for each enrolled appliance, and lockbox or property-manager access with your report emailed.
- Workmanship warranty. A 2-year warranty on the workmanship of repairs TCF performs for members. This covers the repair work performed, not future repairs.
6. Member discounts
- Discounts become available only after your included visit for the term has been performed, and last to the end of your term.
- 10% off repairs and extra visits on the first $3,000 of each job and 5% off the amount above $3,000. 5% off chimney or venting replacements and new stove, insert or fireplace installations.
- Combined limit of $1,000 in discounts per term, across all your enrolled appliances and all jobs. Discounts are calculated on TCF's regular price before sales tax. Trip charges, permits and third-party costs are not discounted and do not count toward the limit.
- If you need a repair before your included visit, TCF can do the included visit on the same trip. Once the visit is performed, discounts apply to that work too. Otherwise, work done before your included visit is performed is at TCF's regular prices.
- Member discounts do not combine with TCF's 3% check, cash or Zelle discount.
- Discounts you have already received are never recovered, and TCF never bills your card to recover them.
7. What the membership does not include
The membership covers the scheduled maintenance visit only. It does not include, and TCF does not promise, any repair or replacement. Repairs, parts, emergency calls, replacement equipment and installations are quoted separately as their own jobs under their own work order. Also not included: Level III and video inspections, additional ladder setups ($40 each before discount), heavy glazed creosote removal, animal or nest removal, permits, and snow or ice removal. TCF services pellet stoves and inserts but does not repair them.
8. Fee, payment and automatic renewal
- First-year fee. Charged by card when you join. It equals TCF's published price for the same maintenance service on the day you join, per appliance, less 10%. Card only, kept on file for renewals. No sales tax applies to maintenance visits; sales tax applies only to parts TCF supplies.
- Automatic renewal. Your membership renews automatically for another 12 months on the day after your term ends (your anniversary date) until you cancel. Your separate, express agreement to automatic renewal is collected at sign-up.
- Renewal fee. 10% off TCF's published price list for the coming season, stated as an exact dollar amount in your renewal notice. TCF archives every price list. The renewal fee is charged on your anniversary date, not earlier.
- Clean-chimney credit. If your chimney does not need cleaning and the visit is done as an inspection only, the difference between TCF's cleaning and inspection-only prices is credited to you against your next renewal. If you cancel instead, the same amount is already counted in the section 10 refund and is not paid a second time.
9. Notices
- After you join, TCF emails a confirmation you can keep, with these terms, your term dates, the cancellation policy and how to cancel.
- 15 to 45 days before each renewal charge, TCF emails one renewal notice: the exact amount per appliance, that it renews yearly, the charge date, and a direct cancel link. A notice that announces a fee increase is sent 15 to 30 days before the charge. If the fee changes after any notice, TCF sends a new notice 7 to 30 days before the charge.
- TCF emails a confirmation after each renewal charge, cancellation and refund.
10. Cancellation and refunds
- Cancel anytime online through Manage or cancel, from the link in any membership email, or by calling (530) 414-7600. Voicemail requests are processed or called back within one business day. There is no cancellation fee.
- Cooling-off. You may cancel within 5 business days after joining for a full refund, for any reason. This right does not depend on whether any service has been performed. If California's home-appliance service-contract rules apply to your membership, TCF also honors the cancellation period, channels and notices those rules require.
- Visit not yet performed. If your included visit for the current term has not been performed, TCF refunds your fee in full.
- Visit performed. Once your included visit has been performed, TCF refunds your membership fee minus the published price of the maintenance service actually performed (the inspection-only price if only an inspection was performed), taken from the price list in effect when that term's fee was set (the day you joined for a first term, the date of the renewal notice for a renewal), and never less than zero. After a full service the fee is that published price less 10%, so this will normally be zero. For example, a wood-burning fee of $283.50 against a published price of $315.00 leaves nothing to refund. If California or Nevada law gives you a different or larger refund, TCF pays whichever is greater. Nothing in these terms limits any right you have under those laws.
- Discounts. Discounts you have already received are never recovered.
- If you cancel and your fee is refunded in full, your benefits and discounts end the day you cancel. If you cancel after your included visit and no refund is due, you keep your benefits and discounts through the end of your term. Turning off automatic renewal never ends benefits you have already paid for; it only stops the next renewal. If the law requires a refund beyond what is stated here, your benefits and discounts end on the date the cancellation takes effect, and TCF values any unused benefits by the method the law requires.
- TCF may end a membership with written notice and a refund of any visit not yet performed.
11. If a renewal payment fails
TCF emails you a secure link to update your card. Your membership stays active for 30 days. When you update the card, you see the exact amount and must approve it before anything is charged. If you do not approve within 30 days, your membership ends on that date, nothing is charged, and you owe nothing.
12. Visits, access and unsafe conditions
- Access. You agree to provide access and keep the appliance cold on the visit day. If TCF arrives in the confirmed window and there is no access, or the appliance that had to be cold is burning, the visit is rescheduled and TCF may charge a $100 missed-appointment fee, a reasonable estimate of the technician's time, travel and the lost slot. The first missed appointment is waived. The fee does not affect your membership or its benefits.
- Weather. If weather or roof conditions stop a visit, TCF returns to finish it at no charge. The return is part of the same included visit.
- Unsafe conditions. The included visit is performed when TCF delivers the inspection and written report. If an unsafe condition prevents the cleaning or service, TCF tells you what remains and either returns after the condition is corrected with no new trip fee, or credits the unperformed portion.
- Moving. Your membership moves with you to a new home in TCF's service area. A replacement appliance takes over the membership; the fee adjusts if the appliance type changes.
13. Changes, records, texting and contact
TCF gives clear notice of any material change to these terms before it takes effect, with how to cancel. TCF keeps a record of your enrollment, consent and each notice for at least 3 years, or 1 year after the plan ends, whichever is longer. Service texts about your membership and appointments are sent to the number you give. Marketing texts are sent only if you separately opt in, and you can reply STOP at any time. Regular inspection and maintenance may help identify conditions associated with chimney fires, operating problems and wear, but cannot eliminate fire or breakdown risk or guarantee equipment life. Questions: (530) 414-7600, admin@tahoestoves.com. These terms are governed by the law of the state where the enrolled property is located (California or Nevada).
